The defendant is the E (ju) representative director in Seo-gu Seoul Special Metropolitan City D, who is a user who runs the taxi transport business using 61 full-time workers.

1. An employer shall pay workers subject to the minimum wage at least the minimum wage rate of at least 4,10 won in the minimum wage rate, during the period from January 1, 201 to December 31, 2011, to the minimum wage rate of at least 4,320 won in the minimum wage rate, during the period from January 1, 201 to December 31, 201, and from January 1, 201, to December 31, 2012, during the period from January 31, 2012, and at least 4,580 won in the minimum wage rate, and during the period from January 1, 201 to December 31, 2012. < Amended by Act No. 11614, Dec. 31, 2013>

Nevertheless, the Defendant paid KRW 2,342 to 19, such as F, etc. working as a driver from July 1, 2007 to the date of the above workplace, KRW 2,560 when the amount of KRW 4,110 was below the minimum wage rate of KRW 4,320 in 201, KRW 2,393 to KRW 4,006 when the amount was below the minimum wage rate of KRW 4,580 in 201, KRW 3,714 to KRW 4,034 when the amount was below the minimum wage rate of KRW 4,580 in 201, KRW 3,714 to the minimum wage rate of KRW 4,860 in 2013, KRW 3,766 to 4,034 when the amount was below the minimum wage rate of KRW 4,580 in 20.

2. The employer shall pay wages on a fixed date at least once a month;

Provided, That this shall not apply to extraordinary wages, allowances, or other similar payments, or those wages prescribed by Presidential Decree.

Nevertheless, as described in the preceding paragraph, the Defendant paid F below the minimum wage of KRW 51,272 through KRW 306,693 each month from July 1, 2010 to March 31, 2013, and paid night allowances of KRW 14,576 to March 31, 2013 each month from July 1, 2010 to below the minimum wage of KRW 49,487 as listed in the attached Table 23 of the day of crime, including those paid below the minimum wage of KRW 53,272,288 each month from August 10 to March 31, 2013, respectively.
