The lower court found the Defendant guilty of the instant facts charged on the grounds indicated in its reasoning.

Examining the evidence duly adopted by the first instance court, the above determination by the court below is just, and contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles as to the principle of non-existence of the day-to-day interest as stipulated in Article 13(1) of the Constitution.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
