1. The defendant is paid KRW 9,110,00 from the plaintiff, and simultaneously the plaintiff is paid KRW 3,00,000, the Dongjak-gu Seoul Metropolitan Government ground.

Reasons

1. Basic facts

가. 피고는 2014년경 서울 동작구 D(도로명 주소 : 서울 동작구 C) 지상 철근콘크리트 평슬래브지붕 4층 근린생활시설 건물(이하 ‘이 사건 건물’이라고 한다)의 공유자 중 1인인 E으로부터 위 건물의 1층 180.99㎡ 중 별지도면 표시 ㉠,㉡,㉢,㉣,㉠의 각 점을 차례로 연결한 선내 32.9㎡(1층 F호, 이하 ‘이 사건 점포’라고 한다)를 임차하여 ‘G’라는 상호로 신발 소매점을 운영하여 오다가, 2015. 2. 하순경 이 사건 건물의 공유지분을 취득한 H와 사이에, H, I, J 소유의 이 사건 점포를 임대차보증금 10,000,000원, 차임 월 700,000원(부가가치세 별도), 임대차기간 2015. 4. 1.부터 24개월로 정하여 임차하기로 하는 계약(이하 ‘이 사건 임대차계약’이라고 한다)을 체결하였고, 이후 2017. 3. 31. 임대차보증금을 9,110,000원으로 감액하여 임대차계약을 다시 체결하였다.

B. On April 16, 2019, K Co., Ltd. (hereinafter “K”) entered into a contract with H, I, and J to purchase the instant building and its site, and completed the registration of ownership transfer as to the instant building and its site on May 23, 2019.

C. On May 22, 2019, between the Plaintiff and the Plaintiff, the non-party company entrusted the Plaintiff with the ownership of the instant building and its site and the aggregate building to be constructed on its land, and the Plaintiff entered into a land trust agreement with the purport that the trust benefits acquired by selling the said land and aggregate building to a third party shall be granted to the priority beneficiary (hereinafter “instant trust agreement”), and completed the registration of ownership transfer for the instant building on May 23, 2019.

On June 4, 2019, the defendant confirmed that the plaintiff was entrusted with the ownership of the building of this case by the non-party company, and specified the bank account for which the defendant will pay rent in the future.
