1. At around 03:00 on November 7, 2012, the Defendant found two copies of the new and non-filled card owned by C, which was lost by the victim C in front of the cross-fluence store located in the Busan Ma-gu Ma-dong, Busan Ma-dong.

The Defendant, without taking necessary procedures such as returning the acquired property to the victim, embezzled the property he/she had on his/her own mind.

Around November 20, 2012, the Defendant violated the Specialized Credit Financial Business Act and the Defendant used a credit card, which acquired economic benefits by settling the prices of goods equivalent to KRW 79,800,00 in total with the above new credit card on 14 occasions, as shown in the attached Table 1, in purchasing beverages and fruit equivalent to KRW 5,800 at the market price at the unmanned machine, which is an information processing unit established in the shipping company located in the Don-dong, Busan Metropolitan City, Daegu Metropolitan City, in the marine transportation Daegu, and paying the price with a c-owned credit card (credit number:D) obtained without authority, and used the lost credit card.

3. 여신전문금융업법위반 및 사기 피고인은 2012. 11. 20. 02:06경 부산시 해운대구 E편의점에서 시가 3,900원 상당의 궁중식 너비아니 정식 1개, 시가 2,500원 상당의 럭키클릭앤롤프레쉬 1개를 구입하면서 불상의 피해자에게 위 제1항 기재와 같이 습득한 C 소유의 위 신한카드를 제시하여 그 대금을 결제한 것을 비롯하여 그때부터 2012. 12. 7. 22:20경까지 별지 범죄일람표2 기재와 같이 총 86개소의 신한카드 가맹점에서 합계 2,789,240원 상당의 물품대금을 위 신한카드로 결제하여 재산상 이익을 취득하고, 분실한 신용카드를 사용하였다.
