1. The Defendant’s KRW 55,700,400 as well as the Plaintiff’s annual rate of KRW 6% from January 5, 2017 to January 29, 2018.
Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 through 3, the plaintiff, who runs a wholesale and retail business of construction materials, supplied the building materials such as light appliances to the defendant from July 30, 2014 to January 4, 2017, and was not paid KRW 55,700,400 out of the price of the goods.
Therefore, the defendant is obligated to pay to the plaintiff 5,70,000 won with 6% per annum under the Commercial Act from January 5, 2017 to January 29, 2018, the delivery date of a copy of the complaint of this case, and 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.
The plaintiff's claim of this case is justified and accepted.
