피고인은 G, H와 함께 위와 같은 방법으로 2013. 6. 20. 18:00경부터 같은 날 22:00경까지 사이에 전남 장성군 I에 있는 D 소유의 황토방 내에서, 피고인은 도박할 사람 10여 명을 모집하고 경비업무를 하면서 이들에게 화투 20장을 사용하여 기본금 10,000원에서 최고 무한대까지 도금으로 걸고 속칭 도리짓고땡(화투 5장을 이용하여 3장으로 10이나 20을 맞추고 나머지 2장으로 끝수가 높은 사람이 이기는 방법) 도박을 하게 한 다음 매회 끝수가 '7' 이상으로 승리한 자로부터 판돈의 10%를 경비 및 도박장 사용료 명목으로 받았다.

가. 피고인은 2013. 6. 20. 18:00경부터 같은 날 22:00경까지 사이에 전남 장성군 I에 있는 D 소유의 황토방 내에서, A이 개설한 도박장에서 위와 같은 방법으로 속칭 ‘도리짓고땡’이라는 도박을 하였다.
