2. Plaintiff B’s Defendants

A. Relevant Plaintiff A Co., Ltd. (former trade name is E Co., Ltd.; hereinafter “Plaintiff A”) is a company that conducts interior construction business, etc., and Plaintiff B is the actual manager of Plaintiff A.

Defendant C (the former trade name is F Co., Ltd.; hereinafter “Defendant C”) is a company that carries on housing construction business, etc., and Defendant C is the representative director of Defendant C.

B. On December 18, 2013, Plaintiff A and Defendant C entered into a contract for construction works with Defendant C as a contractor, and Defendant C entered into a contract for construction works with H apartment units at KRW 250,00 (27,364,00,000 for the construction work (hereinafter “instant construction work”) and carried out the construction work at KRW 27,364,00,000 (hereinafter “instant construction work”).

Plaintiff

A and Defendant C entered into a contract on November 13, 2014 by changing the construction cost of the instant case to KRW 28,624,00,000.

C. On September 1, 2015, Plaintiff A prepared an agreement with Defendant C on September 1, 2015, and borrowed KRW 1 billion from Defendant C pursuant to Article 3 of the agreement.

1. As of August 31, 2015, the balance of the contract construction cost to be paid by Defendant C to the Plaintiff of the construction project as of August 31, 2015 is KRW 3,868,906,200.

2. Methods of payment of construction expenses;

(a) Payment by substitute: 700,088,400 won (the amount after deducting loans from ten households);

(b) Cash payment: 50 million won (payment with loans) on September 1, 2015, 200 million won (payment with loans) on September 24, 2015 (payment with loans) and on October 5, 2015, 200 million won on October 718, 2015, 200 million won (payment with borrowed funds)

3. A contractor for borrowing support funds shall be provided with the extended construction cost to be paid by a contractor from the contractor as security, and on September 3, 2015, 500 million won;

9.24.50 million won, a sum of one billion won shall be borrowed on condition of 2% per month, and the principal and interest shall be settled from the total amount of extended construction cost to be paid to the contractor and to be received from the contractor.
