From January 2016, the Defendant had been working as a pastor of the C church located in the Chungcheongbuk B, and had the victim D (ma, 62 years old) who was suffering from mental retardation disorder 1 around 2012 seeed in the above church upon the request of E by the mother of the victim who was the new victim of the above church. From January 2016, the Defendant had the victim, who was the victim of the above church, worked as a volunteer for the activities of disabled persons in F, provided medical care and support services by having the victim and other disabled persons reside in the above church.

1. No person who has violated the Act on Welfare of Persons with Disabilities (including violence and emotional abuse of persons with disabilities) shall commit violence against the body of any disabled person or commit emotional abuse detrimental to the mental health and development of any disabled person;

Nevertheless, from around 10:36 to April 10:57, 2020, the Defendant committed emotional abuse, such as assaulting the body of the disabled victim and covering the victim's face with only one time by hand, and covering the victim's face with a hand, by using the body of the disabled victim at least five times in total as indicated in attached Table 1 and in the same manner as indicated in attached Table 1, from around that time to April 28, 2020.

2. No person who violates the Act on Welfare of Persons with Disabilities (use of money and goods for any purpose other than its original purpose), or embezzlement may use the money and goods donated or provided for persons with disabilities for any purpose other than its original purpose;

Nevertheless, while the Defendant managed the passbook in the name of the victim where the housing benefits, etc. paid to the victim D from around 2012 are deposited, the Defendant paid KRW 560,000 out of KRW 627,130,000 to the bank account of the victim around October 18, 2013. < Amended by Act No. 11903, Oct. 21, 2013>
