A defendant shall be punished by imprisonment for not more than ten months.
Punishment of the crime
On February 12, 2020, the Defendant was sentenced to a suspended sentence of one-year imprisonment at the Seoul Central District Court on February 12, 2020, and the judgment became final and conclusive on the 20th of the same month, and is currently under the suspended sentence.
1. On January 27, 2020, the Defendant, at the Defendant’s office located in Seocheon-si B around January 27, 2020, posted a false statement to the effect that, “I sell a stong (Stong)” on the Internet CKapet bulletin board, the Defendant sent a false statement to the effect that I would send the after one week visibility if I deposit 20,000 won of the price for the goods.
However, due to the fact that the defendant did not have visibility, even if he receives the price of goods from the victim, he did not have the intention or ability to sell the visibility to the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 20,000 on the same day from the victim’s E account in the name of the Defendant.
2. On February 3, 2020, the Defendant made a false statement to the effect that “Around February 3, 2020, at a place where the place is unknown, the Defendant visited the victim under the above paragraph (1) at a place where the location is unknown, and that “A more than a time is not sent, and if a deposit of KRW 20,000 is made, the Defendant will send one at sight (s and scams).”
However, due to the fact that the defendant did not have visibility, even if he receives the price of goods from the victim, he did not have the intention or ability to sell the visibility to the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 20,000 on the same day from the victim’s E account in the name of the Defendant.
2. On March 1, 2020, the Defendant posted a false statement to the effect that, at around 01:18 on March 1, 2020, the Defendant would deliver the goods to the victim G who believed and contacted that “the 60,000 won of the price of the goods is deposited,” at a place where the place is unknown.
However, the defendant is true.
