A judgment without pleading (Article 208(3)1 and Article 257 of the Civil Procedure Act): Provided, That the Plaintiff claims damages for delay at the rate of 20% per annum from October 10, 2006 to the date of full payment. However, the provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings was amended by Presidential Decree No. 26553, Oct. 1, 2015 to 15% per annum, and thus, the Plaintiff’s claim for damages for delay that exceeds 15% per annum after October 1, 2015 is dismissed.
