A. The Plaintiff is an autonomous management organization organized by occupants pursuant to the Act on the Ownership and Management of Aggregate Buildings for the management and operation of A Apartments (hereinafter “the apartment of this case”) in Bupyeong-gu, Seocheon-gu, Seoul. The Defendant is a corporation that operates construction business.

B. The Plaintiff and the Defendant’s construction contract conclusion process (1) concluded the instant apartment complex (hereinafter “the instant apartment complex”) on May 6, 201, the Plaintiff announced the announcement on May 6, 201 in order to replace the existing news reporting block and the guard stone. On May 13, 2011, the Plaintiff issued the specifications prepared by C of the instant apartment management office against the participating companies in the instant apartment complex and held the site site consultation committee.

(2) On May 20, 2011, the Defendant submitted a written estimate to the Plaintiff, and the Plaintiff selected the Defendant who participated in the bidding on the same day at the lowest price as the construction company.

(3) Since then, the Plaintiff had to add the instant apartment complex to the instant apartment complex replacement project, and received a written estimate from the Defendant on June 2, 201, regarding the said additional construction project.

(4) On June 2, 2011, the Plaintiff concluded a construction contract with the Defendant for the construction of this case with the construction cost of KRW 233,800,000 as to the instant construction work (i.e., the replacement part of the sidewalk block and the replacement part of the boundary stone), which was added to KRW 189,800,000, and the construction period from June 7, 201 to August 6, 2011.

The construction of this case and its subsequent circumstances (1) around September 1, 2011, the Defendant completed the construction of this case, and submitted the completion system to the Defendant on September 2, 2011, which is the next day.

(2) After the completion of the instant construction project, the Plaintiff discovered the phenomenon of distributing, cutting, and glue, etc. of news tables, and from March 15, 2012, the Defendant from March 15, 2012.
