1. The defendant shall pay 170,000,000 won to the plaintiff and 12% per annum from April 1, 2011 to the day of complete payment.
1. According to the evidence No. 1 of the judgment as to the cause of claim No. 1, the plaintiff and the defendant paid 20 million won as agreed upon to the plaintiff in relation to the criminal complaint case against C on March 24, 2008. Among them, 20 million won shall be paid in April 30, 2008, respectively, and the remaining KRW 170 million shall be deposited in the plaintiff's account from June 2008 to May 30, 2008, and in case of arrears, 50 million shall be deposited in the plaintiff's account, but it can be recognized that the plaintiff and the defendant agreed to pay damages for delay by adding 1% per month to the unpaid amount.
Therefore, the Defendant is obligated to pay the Plaintiff the remainder of KRW 170 million, excluding the amount of KRW 50 million paid to the Plaintiff, and to pay damages for delay at the rate of 12% per annum from April 1, 201 to the date of full payment, as the Plaintiff seeks.
2. In conclusion, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
