A defendant shall be punished by a fine of 500,000 won.

When the defendant does not pay the above fine, 100,000 won.

Reasons

Punishment of the crime

Pursuant to the Daejeon High Court Order 2015 Seocho Jae-339 dated August 21, 2015, public prosecution was instituted only for the above facts constituting the crime.

The Defendant is an international marriage broker who operates C marriage brokerage center (the trade name after the change is referred to as “D”) in the petition district B at the Cheongju-si.

On March 15, 2013, the Defendant entered into a contract for the purpose of marriage brokerage with the user E who requested international marriage brokerage, and on March 29, 2013, the Defendant viewed F with F, without providing in writing the other party to marriage brokerage with personal information of the translation of F, in the trade name in the world where the Republic of Korea is outside the Philippines, and without providing in writing the other party to marriage brokerage.

Accordingly, the defendant did not provide personal information of the other party to the user who entered into a contract for marriage brokerage.

1. Articles 70 and 69(2) of the former Criminal Act (amended by Act No. 12575, May 14, 2014).

1. Article 10-2(1) of the Act on the Management of Marriage Brokerage Business for the Reasons of guilt under Article 334(1) of the Criminal Procedure Act (hereinafter “Marriage Business Act”) provides that “the international marriage broker shall provide users with personal information of the other party in writing, and obtain personal information from the users who have entered into a contract under Article 10(1) of the Marriage Brokerage Business Act, and provide the other party with such information.” However, the Marriage Brokerage Business Act does not limit the provision of personal information of the other party only to the users who have entered into a written contract for marriage brokerage.
