A. The plaintiff is a corporation established for the purpose of real estate sales business, and the defendant is a corporation established for the purpose of the construction business.

B. On September 23, 2015, B, the Plaintiff’s representative director, concluded a construction contract (hereinafter “instant construction contract”) with the Defendant, setting the construction period from October 1, 2015 to October 31, 2016, with the construction cost of KRW 5,230,000 (excluding value-added tax) and KRW 1/100 (1/100) for liquidated damages (hereinafter “instant construction contract”).

C. After that, on May 3, 2016, B completed the registration of transfer of ownership on the ground of the sale of the instant real estate on the same date, the Plaintiff (the Plaintiff’s trade name was “Stock Company E,” and on May 11, 2016, the Plaintiff entered into a construction contract with the Defendant for the instant construction contract by changing the contractor from B to “A,” which is the Plaintiff’s trade name, at the time of the time of the instant construction contract from “B” (hereinafter “the first change contract”). Since the Plaintiff’s trade name was changed to “A,” the Plaintiff entered into a new construction contract with the Defendant to change the contractor into “A,” which is the Plaintiff’s trade name as to the first change contract (hereinafter “the second change contract”).

On the other hand, on October 12, 2016, the Defendant’s construction completion period of the instant construction contract was extended on the ground that “the construction was conducted simultaneously with the adjacent site at the time of the commencement of the construction work, and the construction was not carried out until the completion of any one place until the completion of the construction work, and the construction was delayed due to the increase of rainfall compared with the towing year during the construction period,” and that “the completion period of the instant construction contract was extended on October 31, 2016.”
