The defendant shall pay 40,00,000 won to the plaintiff and 24% per annum from January 29, 2017 to the day of complete payment.
1. According to the facts that there is no dispute between the parties to the judgment on the cause of the claim, the entries in Gap evidence Nos. 1 and 2 (including additional numbers), and the purport of the entire pleadings, it is recognized that the plaintiff lent 40,000 won to the defendant on August 10, 2016 by setting the rate of 30% per annum and the due date of repayment as August 10, 2017. The plaintiff was paid interest calculated in accordance with the interest limit rate under the Interest Limitation Act until January 28, 2017.
Therefore, the defendant is obligated to pay to the plaintiff 40 million won and damages for delay calculated by the rate of 24% per annum as claimed by the plaintiff from January 29, 2017 to the day of full payment.
2. The plaintiff's claim for conclusion is reasonable, and it is so decided as per Disposition.
