피고인은 2017. 6. 3. 02:46 경 고양 시 덕양구 C 아파트 206 동 앞 대로에서, 자신의 D 쏘렌 토 승용차를 운전하여 지나가던 중, 길가에 일면식이 없는 피해자 E( 여, 33세) 가 술에 많이 취하여 담장에 기대어 서 있는 것을 발견한 후, 승용차를 정 차시키고 피해자에게 “ 집까지 태워 주겠다” 고 하며 접근하여 피해자를 조수석에 태운 다음, 같은 날 03:00 경 위 승용차를 같은 구 F에 있는 인적이 드문 비포장 도로로 임의로 운전하여 가 으슥한 곳에 정차시킨 후, 갑자기 피해자가 앉아 있던 조수석 의자를 뒤로 눕히고는 피해자의 바지를 잡아 하의를 벗기려 하고, 이어 술에 취하여 정신을 제대로 차리지 못하는 피해자가 손으로 바지를 붙잡으며 바지를 벗기지 못하게 하려는 것을 무시하고, 강제로 피해자의 바지와 팬티 등 하의를 모두 벗긴 다음, 자신도 하의를 모두 벗고, 계속하여 피해자가 당황하고 몹시 겁을 먹은 나머지 적극적으로 저항하지 못한 채 피고인에게 “ 하지 마라, 신고하겠다” 는 등의 말을 하며 저항하는 것을 무시하고, 피해자를 몸으로 누르는 등으로 피해자의 반항을 억압하며 강제로 피고인의 성기를 피해자의 음부에 삽입함으로써, 피해자를 강간하였다.
