A and Defendant B opened an Internet homepage with the trade name “F” around August 2013, and opened an Internet homepage (H) with the trade name “G” around February 2015, and operated a driving school. Defendant C and Defendant D are those who provided road driving education by arranging students from a large number of non-registered training businesses, including the above G, with the trade name “G.”

No one shall conduct driving education for automobiles, etc. by allowing the Commissioner General of the competent Regional Police Agency to use a facility to conduct driving education for automobiles, etc. and practice driving training for automobiles, etc. conducted in the name of a driving school, etc. outside of a driving school, etc. in return for payment or by lending the name of a driving school, etc.

Defendants A and B did not register with the Commissioner General of the Korean National Police Agency under their jurisdiction, and Defendant A established an Internet homepage of the above “G” under their own name and registered as a business operator, and Defendant B intended to take charge of managing and operating the Internet homepage, telephone consultation, and the distribution of students, and subsequently, introduced the participants of the road driving on the Internet website recruited through the above Internet homepage to J and C, and recruited them to operate the Motor Vehicle Driving Authority in a way of distributing the profits in accordance with their performance by receiving the introduction fees from the driving instructors.

On August 17, 2013, A and B informed K of the name and contact point, area, class hours, and amount of non-qualified private students who applied for the road driving education through the above Internet homepage at a non-permanent place.

The above K has received an amount of US tuition from the above students, conducted driving education on the road of the vehicle on the roads in Seoul Special Metropolitan City, and then is the job placement fee for the above students.
