except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

From April 2004 to September 2014, the Defendant: (a) was a person who operated a “D” restaurant located in Thai City from around 2004 to around 2014; (b) from around 2007 to around 2007, the Defendant was liable for loans and livestock product payments worth at least KRW 500,000,000 to the extent that it is impossible for the Defendant to repay his own funds due to excessive personal debts and the operational failure of the said restaurant; and (c) as the interest and living expenses of the profits incurred from the above restaurant are higher than those of the above restaurant, the Defendant was able to receive money from a large number of accounts and use it

The victim E-related defendant: around February 25, 2012, at the victim E's house located in Thai City F and 405, and at the victim E's house organized by the victim, 21 members of each fraternity for 21 month from February 25, 2012 to October 25, 2013, he/she received the amount of "20 million won (20 million won - 1)" as a deposit in the order of 25th day of each month; the victim E-related defendant agreed to receive the amount of KRW 1,00,000 won per month before the receipt of the deposit; KRW 1,200,000 won per month; KRW 1,200,000 won per month after the receipt of the deposit; KRW 21,201,205,201,251,2000 won per month; and KRW 261,2015,2015.

However, even if the Defendant joined and designated a true fraternity, the Defendant had a lot of obligations as seen earlier, and was planned to receive the fraternity in advance and use it for the repayment of other obligations, so there was no intention or ability to pay the fraternity every month until the fraternity ends.

Nevertheless, according to the aforementioned sequence from the victim, the defendant is only KRW 16 million on February 25, 2012 and KRW 1,635 million on May 25, 2012 from May 29, 2012.
