A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Punishment of the crime
The defendant, after entering the Republic of Korea on May 16, 1996, was illegally staying in excess of the period of sojourn, and was subject to a departure order on August 31, 1998 and was voluntarily departing from the Republic of Korea, making it difficult to enter the Republic of Korea under the name of the defendant.
Since then, the Defendant had a mind to re-entry the Republic of Korea for employment on 1999, made a passport under the name Ma (one-person D) by using the nameless Bracker, and entered the Republic of Korea on March 17, 2001 through a disguised marriage with E on March 17, 201, and acquired the nationality of the Republic of Korea through a simple naturalization in the name of D without the above permission on April 25, 2005.
1. On April 2, 2008, the Defendant: (a) prepared a false divorce report in the name of Noison; and (b) submitted it to the public official in charge of family registration who is aware of such fact at the public service center of Pyeongtaek-si office; (c) had the public official in charge enter false facts in the family registration information system, which is the public electronic records, and exercised the public electronic records that have been falsely entered by allowing access to it around that time;
2. On June 7, 2010, the Defendant was undergoing an entry inspection at the Incheon Airport entry inspection place, and the Defendant exercised a false entry passport by presenting a Korean passport (F) in the name of the deceased D to the public official in charge of immigration inspection who is unaware of the circumstance.
3. On June 8, 2010, the Defendant, who violated the Passport Act, prepared an application for issuance of a passport in the name of D without permission at the public service center of Pyeongtaek-si Office, and submitted it to the public official in charge of issuance of a passport who knows the fact, and on June 9, 2010, the public official in charge issued a passport in the name of D without permission to the Defendant and issued the passport to the Defendant.
As a result, the defendant made a false report to a public official, entered false facts in a passport, and received a passport by unlawful means.
4. The Defendant shall be the Incheon Airport on June 21, 201.
