1. The defendant shall pay to the plaintiff KRW 283,705,230 and the amount of KRW 200,000 among them, from March 8, 2015 to the date of full payment.
In full view of the purport of the arguments in Gap evidence Nos. 1 through 5, the plaintiff loaned 200 million won to the defendant on October 11, 2010, with the interest rate of 6.5% per annum, the maximum interest rate of delay damages (change rate) 22% per annum, and the due date of repayment on October 11, 2015. The defendant delayed the payment of interest on the above loan and lost the interest due date on December 26, 2012. The plaintiff applied for an auction on the real estate provided by the defendant to secure the payment of the above loan and interest, but failed to receive dividends, the defendant did not receive dividends, as of February 2, 2015, the principal bears the principal amount of KRW 283,705,230,00,000,000 per annum, 200,000,000 won, 20,717,715,757,715).
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay at the rate of 18% per annum from March 8, 2015 to the date of full payment, following the delivery of the instant complaint to the Defendant, as requested by the Plaintiff, with respect to KRW 283,705,230 and the principal amount of KRW 200 million.
