1. Basic facts
A. On June 4, 1975, C completed the registration of transfer of ownership on the ground of inheritance on June 9, 1973 as to each real estate listed in [Attachment 1 List 1 List 1 List 1 List 2 (hereinafter “real estate listed in Annex 1 List 1 List 2”) by subrogation of the registration of transfer of ownership on the ground of inheritance.
B. D, on August 29, 1981, on the real estate listed in paragraph (4) of the [Attachment List No. 4 (hereinafter “instant 4 real estate”) as of October 20, 1950, on the real estate listed in Annex No. 1 List No. 3 (hereinafter “instant 3 real estate”) as of June 15, 1990, on September 10, 1979, on the ground of inheritance by consultation and division, registered each of the instant 1 and 2 real estate as to September 6, 2009, on each of the instant 1 and 2 real estate due to inheritance by consultation and division on September 10, 1979.
C. On February 13, 2009, the Defendant delegated the implementation of the procedures for the registration of ownership transfer of the first and fourth real estate of this case to a certified judicial scrivener E on the same day (hereinafter “instant sales contract”) on the grounds of a sales contract between the Defendant and D, and the said power of attorney affixed the seal imprint of D.
Accordingly, on February 24, 2009, a certified judicial scrivener E applied for the registration of transfer of ownership in the name of the defendant with respect to the real estate of this case Nos. 1 through 4,300,000 won, together with a sale list, a real estate transaction contract certificate, a certificate of completion of report, a certificate of personal seal for sale of real estate issued by D himself on December 19, 2008, a certificate of confirmation confirming that the person liable for registration is D, and a copy of D resident registration certificate.
Accordingly, on February 24, 2009, the Defendant completed the registration of ownership transfer on the ground of sale on February 13, 2009 with respect to the first through fourth real estate of this case (hereinafter “instant registration of ownership transfer”). D.
