1. The remaining amount after deducting the expenses for auction from the proceeds of each real estate listed in the separate sheet sold to an auction;
The Plaintiff and the Defendants are co-owners who own 1/5 shares of each of the real estate listed in the separate sheet (hereinafter “instant real estate”). The real estate of this case was scattered by unauthorized buildings, warehouses, toilets, etc. on the ground of this case, and the fact that no agreement was reached between the Plaintiff and the Defendants on the division of the instant real estate and the removal of the relevant ground buildings does not conflict between the parties.
According to the above facts, it is reasonable to divide the real estate of this case by auction in a way of distributing to the plaintiff and the defendants the remaining amount after deducting the auction cost from the price by auction.
Therefore, the plaintiff's claim shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
