A. The defendant is the former owner of each real estate listed in the separate sheet (hereinafter "each real estate of this case", and according to the sequence Nos. 1 through 6). D, the defendant's representative director, was a company E (the trade name before the change: F. hereinafter "E") and the defendant, engaged in the business of collecting stone from each real estate of this case.

Plaintiff

A Co., Ltd. (hereinafter “Plaintiff Co., Ltd.”) is the purchaser of each real estate of this case, and Plaintiff B is the actual operator of Plaintiff Co., Ltd., and the husband of G, the representative director of Plaintiff Co., Ltd., and the relationship between D and private.

B. Acquisition of quarrying permission by the Defendant and E (1) around May 198, after obtaining quarrying permission from the head of Mansan-gun in the forest location, H, 13,896 square meters in the permitted area, and period of quarrying and removal from June 1, 198 to May 31, 1998, the stone was cut in the course of quarrying work, and around 31,984 square meters in the forest location (i) around June 1, 1994; (ii) additional quarrying permission was obtained from the head of Mansan-Gun to 16,152 square meters in the production site; (iii) additional quarrying permission was continued from September 1, 1994 to 198 square meters in the area of the forest; and (iv) additional quarrying permission was granted from September 1, 1994 to 198 square meters in the area of the forest to 198 square meters in the area of the access road; and (v) additional quarrying permission continued to be granted from 97 square meters and 98.5 square meters in the area.

(2) Meanwhile, around June 1994, the Defendant established an access road after obtaining a quarrying permit from the head of Yansan-gun to H and J, a permitted area of 37,047 square meters in the forest location (i.e., 11,485 square meters in a stone collection site, 6,205 square meters in a place where 19,200 square meters are treated as 11,485 square meters in a place where quarries are located), and a stone collection work is conducted after obtaining a quarrying permit from September 1994 to May 198, 199. A stone collection work is conducted on or around December 1994 from the head of Yansan-gun to the forest located in the forest, the permitted area of 34,218 square meters in a place where Yansan-gun is located, 15.
