On December 4, 2014, the Defendant stated that “D” under the mutual clothes of “D” operated by the Defendant in Gangseo-gu Seoul Metropolitan Government, which was operated by the Defendant in Gangseo-gu, Seoul, provided that “The victim E shall have money to purchase cosmetics. When lending money, he/she shall repay the money without a mold thereafter.”

However, in fact, the defendant had almost little income because the operation of the clothes operated by him was difficult, and there was no intention or ability to repay it even if he borrowed money from the victim because the personal debt reaches the detention unit, and the situation where only 60 million to 7 million won should have been disbursed every month.

As such, the Defendant, by deceiving the victim as such, obtained a total amount of KRW 6 million from the victim’s account in the name of the Defendant to the national bank account in the name of the Defendant on the same day, KRW 3 million on December 8, 2014, KRW 4 million on December 12, 2014, and KRW 10 million on December 30, 2014, respectively, and acquired property benefits equivalent to KRW 23 million on December 30, 2014.

around December 23, 2014, the Defendant stated that “A” in D, the victim F, “I would complete payment without any mold if I would lend money that is necessary to purchase cosmetics.”

However, in fact, the defendant had almost no income due to the difficulties in operating clothes, and even if he borrowed money from the victim due to the personal debt amounting to KRW 300 million, there was no intention or ability to repay the money.

As such, the Defendant, by deceiving the victim, received 2.7 million won from the victim to the national bank account in the name of the Defendant on the same day, and acquired pecuniary benefits equivalent to the above amount from the date and time to January 12, 2015, and acquired pecuniary benefits equivalent to the above amount, as stated in the attached crime list, from the above date and time to January 12, 2015.
