Defendant shall be punished by a fine of four million won.
If the defendant does not pay the above fine, KRW 100,000.
Punishment of the crime
1. Around January 13, 2019, the Defendant, at the Defendant’s house located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, posted a false statement to the effect that “S864G mobile phones will be sold when galloning gallon,” by accessing the Defendant’s house located in Chungcheongnam-si, Chungcheongnam-si, and that “If galloning gallon, galloning KRW 190,000,000,000 is remitted, she will send the said mobile phone machine to the Defendant’s home.”
However, in fact, the defendant thought that he will use the money received from the victim for the purpose of living expenses, etc., and did not have the above mobile phone, so even if he received money from the victim, he did not have an intention or ability to send the money
Nevertheless, the defendant received 190,000 won from the victim to the E-Union account (F) in the name of the defendant for the same day.
Accordingly, the defendant was given property by deceiving the victim.
2. Around January 14, 2019, the Defendant, at the Defendant’s house located in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, posted a false statement to the effect that “S864G mobile phones will be sold when galloning gallon,” by accessing the Defendant’s house located in Chungcheongnam-si, Chungcheongnam-si, and that the Defendant would send the said mobile phone machine to the victim G who reported and contacted with the victim, “If galloning KRW 224,000,000, the said mobile phone machine will be forwarded to the Defendant’s house.”
However, in fact, the defendant thought that he will use the money received from the victim for the purpose of living expenses, etc., and did not have the above mobile phone, so even if he received money from the victim, he did not have an intention or ability to send the money
Nevertheless, the Defendant received 224,000 won from the victim to the E-Union account (F) in the name of the Defendant for the same day.
Accordingly, the defendant was given property by deceiving the victim.
3. The Defendant committed a crime against the Victim H is prone to the Chungcheongnam-si around February 23, 2019.
