Reasons

Punishment of the crime

Any person who intends to operate a general restaurant business shall be equipped with the facilities prescribed by the relevant Acts and subordinate statutes and report it to the competent authorities.

그럼에도 불구하고 피고인은 영업신고를 하지 아니하고, 2013. 12. 18.부터 2014. 10. 22.까지 서울 성북구 B 건물에서 ‘C’라는 상호로 약 66㎡ 규모의 영업장에 냉장고 3대, 탁자 7개, 씽크대와 조리시설 일체를 갖추어 놓고, 성명불상의 손님들을 상대로 옻닭, 삼계탕을 조리판매하여 월 평균 60만 원 상당의 매출을 올리는 일반음식점 영업행위를 하였다.
