1. Basic facts
A. The Plaintiff filed a lawsuit with the Seoul Eastern District Court No. 2012 Ghana1042 against the Defendant C&S Korea Co., Ltd. (hereinafter “Defendant C&S Korea”), and rendered a judgment in favor of the Plaintiff. The said judgment became final and conclusive around that time.
B. On December 31, 2013, Defendant UPS Korea entered into a contract with the Incheon Transport Authority on a contract amount of KRW 68,581,500 with respect to “the area of telecommunications service for platform safety (PSD) auxiliary facilities (PSD).” Accordingly, Defendant UPS Korea acquired the construction cost claim against the Incheon Transport Authority (hereinafter “instant claim”).
C. On February 13, 2014, the Plaintiff was issued an assignment order of claim attachment and assignment order (hereinafter “instant order”) with the Incheon District Court 2014TT No. 2014TT4587 regarding the part of the instant claim that the Incheon Transport Authority is obligated to pay to Defendant UPS Korea at present and in the future, based on the original copy of the judgment under the foregoing paragraph (a). The instant order is served on the Incheon Transport Corporation, a garnishee, on February 17, 2014, which is a debtor.
