A. The Plaintiff’s status (1) 7th underground floor in Busan Shipping Daegu and A, 30th ground B hotel in most of its underground parking lots, 1 to 3th above ground is used as neighborhood living facilities (50st floor), 4th above ground as hotel offices and restaurants, and 5 to 30th above ground, each hotel with convenience facilities, such as living rooms, washing rooms, and kitchen rooms, as the rest of the 5th to 30th above ground was provided, is an aggregate building with 416th above all guest rooms as a type of hotel hotel with convenience facilities, such as rooms, washing rooms, and kitchen rooms.

(C) On July 14, 2006, the Minister of Maritime Affairs and Fisheries reported to the head of the Ministry of Maritime Affairs and Fisheries on July 24, 2006 the establishment of 416 entire guest rooms among the instant building, and completed registration of preservation of ownership on July 24, 2006.

(3) In the meantime, C was unable to pay the construction cost of the instant building to the Coul Construction Coul Construction Co., Ltd., a contractor (hereinafter “Coul Construction”), and on September 21, 2009, transferred the status of the said accommodation proprietor and the status of the managing body of the instant building to the Plaintiff, a subsidiary company of Coulul Construction.

(4) The Plaintiff completed the report on the succession to the status of the proprietor of the lodging business on September 22, 2009, and completed the management of the entire accommodation and the entire building of this case for 416 guest rooms. The number of guest rooms the Plaintiff is entrusted by each sectional owner on August 4, 2010, and thereafter changed to 223 guest rooms from July 1, 201, respectively.

B. (1) The Defendant entered into an agreement on the consignment operation with the sectional owners of 168 rooms among the guest rooms of the instant building, and submitted a report on the accommodation business with the number of business rooms of 168 rooms on July 3, 2012 to the head of the Shipping Authority, but on the same day.
