1. All claims filed by the Plaintiff (Counterclaim Defendant) are dismissed.

A principal lawsuit and a counterclaim shall be deemed to be combined.
1. Basic facts
A. Around the end of 2015, the Defendant entered into a supply contract with E Co., Ltd. for the purpose of procuring the quantity of capital reduction used as materials for capital reduction (F), and agreed to supply capital reduction produced by requesting individual farmers or small groups to grow capital.
B. Accordingly, on January 13, 2016, the Defendant entered into a contract for the entrusted production of capital between the “GFFE” and H H HFE farmers in the Ansan-dong area including the Plaintiffs (hereinafter “instant contract”), and the specific contents are as follows.
제4조[계약 및 인도조건] ① 계약단가 및 규격 ＊ 노지생산 : 620원/kg ＊ 수매하는 감자는 정상 생육한 완숙품으로 부패, 기형, 충해, 절상, 열개, 녹변(녹화), 창가병(더뎅이병), 흑색심부병, 연(검)부병, 홍색 부패병, 젖은 감자 등의 상품성이 없는 감자는 제외된다.

＊인도시기는 원고들과 피고가 협의하여 결정하되, 수확되는 즉시 원고들은 피고가 원하는 목적지까지 배송한다.
③ 품질기준 ＊ 70g이상 180g미만 감자수매(평당 5kg미만 납품하면 계약위반) ＊ 타품종(수미 등 비가공용 품종) 혼입 경우 전량 반품 및 수매거부 제5조[계약시기 및 대금결제] ① 계약시기는 파종 3개월 전부터 한다.
(2) Down payment: Cown capital (32,000/20kg) shall be substituted from the down payment, and it shall be offset and processed at the time of the settlement of the balance.
30% of the down payment shall be paid on the 15th day or 30th day of the relevant month in accordance with the payment regulations of the company based on the 30th day after the contract.
(3) Any balance: The plaintiffs shall be paid on the basis of the approval 15 days after the acceptance and confirmation of the object.
Article 6 (Cropulation and Purchase Schedules) - Goods for which the normal growth period for each kind of product has expired shall, in principle, be harvested in consultation between the plaintiffs and the defendant.
