부당이득금
1. The judgment of the court of first instance is modified as follows.
The defendant shall pay to the plaintiffs KRW 25,178,702 and KRW 22,075,362 among them.
1. Basic facts
A. The Plaintiffs are between the father and father.
A. The Yongsan-gu Seoul Metropolitan Government owns 1/2 shares of Yongsan-gu 79.6 square meters (hereinafter referred to as the “instant land”), and the Defendant owns a building of Yongsan-gu, Seoul, E-gu and its ground (hereinafter referred to as the “instant building”) adjacent to the instant land.
나. 1) 원고들과 피고는 이 사건 토지를 두고 오랫동안 다투다가 원고 A이 선정당사자가 되어 피고를 상대로 부당이득의 반환을 구한 사건(서울서부지방법원 2013가단7564호)에서 2013. 11. 8. 피고가 이 사건 토지 중 일부를 권한 없이 점유하고 있음을 들어 부당이득 반환을 명하는 판결 위 서울서부지방법원 2013. 11. 8. 2013가단7564 판결은 2013. 11. 30. 확정되었다. 이 선고되었는데, 위 사건에서 피고가 점유하고 있는 것으로 인정된 부분은 별지 2 도면 표시 ㉮ 부분 3.6㎡, ㉱ 부분 4.9㎡, ㉳ 부분 13.7㎡ 합계 22.2㎡ 상당이었다. 2) 원고들은 2014. 1. 11. 피고와 사이에 원고들이 피고에게 이 사건 토지 중 별지 2 도면 표시 ㉮, ㉳ 부분 및 ㉵ 부분 별지 2 도면 표시 ㉵ 부분 중 같은 도면 표시 ㉮, ㉳ 각 부분에 접한 부분에 해당한다.
A lease contract was entered into with a total of about 30 square meters on a rent of KRW 1.5 million per month.
C. On March 3, 2014, the Plaintiffs changed the said lease agreement with the Defendant to a deposit of KRW 170 million, and one-year lease contract (hereinafter “the lease agreement of this case”) for a one-year lease term (hereinafter “the lease agreement of this case”), and on March 6, 2014, in order to secure the Defendant’s obligation to repay the said deposit, the Plaintiffs completed the registration of creation of a neighboring mortgage of KRW 170 million with respect to the instant land (hereinafter “registration of creation of a neighboring mortgage of this case”) by the obligor, the amount of maximum debt of KRW 170 million,000,000,000 from the Defendant until May 30, 2014.
