Defendants shall be punished by a fine of KRW 10 million.

If the Defendants did not pay the above fines, they shall be prohibited.

Reasons

Punishment of the crime

1. Although a person who is not a licensed real estate agent using a similar title as a licensed real estate agent is unable to use the name of licensed real estate agent or any other similar name, the Defendants conspired and used the name of licensed real estate agent or any other similar name by using the name of “D”, “G”, and “mediation” as a broker for the purchase of land, etc. F in the Gyeonggi-gu World Trade Organization C around July 15, 2017.

2. Although a person who intends to operate brokerage business of operation of a non-registered brokerage office shall register the establishment of the brokerage office with the head of the Si/Gun/Gu having jurisdiction over the area which intends to establish the brokerage office as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport, the Defendants conspired to do

A. From around July 15, 2017, in the case of “D” located in the Gyeonggi-gu Gyeonggi-gun Co., Ltd. around July 15, 2017, for the purpose of mediating the conclusion of a contract under which E purchases 10 million won F and 351 square meters from H to 185 million won in the purchase price, the seller receives KRW 10 million from H under the pretext of a brokerage commission, and receives KRW 2 million from E;

B. On July 28, 2017, in the case of “D” located in the Gyeonggi-gu Gyeonggi-gun Co., Ltd. on and around July 28, 2017, E concludes a contract for mediating the purchase of the I 220 square meters in the purchase price of KRW 90 million from the seller J company (representative K) and receives KRW 20 million from the seller J company (representativeK) under the pretext of brokerage commission;

C. From around August 7, 2017, in the “D” located in Gyeonggi-gu World Trade Organization, E mediates the conclusion of a contract that purchases approximately KRW 410,00 in two parcels of Gyeonggi-si L from the seller M in the purchase price of KRW 155,80,000,000, and receives KRW 6,150,000 from the seller M in the name of brokerage commission;

D. Around September 21, 2017, “D” located in Gyeonggi-si Co., Ltd. in Gyeonggi-gu, engaging in brokerage business with a total of KRW 350,000 of KRW 340,000,000,000,000,000,000,000,000 from the seller P, as a broker fee, received KRW 20,000 from the seller P.
