The prosecution of this case is dismissed.
1. On May 3, 2020, at around 14:30 on May 3, 2020, the Defendant: (a) on the street in front of Dongdaemun-gu Seoul Metropolitan Government, asked the victim D (the age of 54) about where the direction is high; (b) cut back the victim’s back by hand; and (c) assaulted the victim’s part on the part of the victim to the next end.
2. The above facts charged are the crimes falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the clearly expressed will of the victim under Article 260(3) of the Criminal Act.
However, according to the records, it is recognized that the "Agreement", which was signed by the victim on November 19, 2020 after the prosecution of this case, was submitted to this court.
Therefore, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
