The prosecution of this case is dismissed.

Reasons

The summary of the facts charged of this case is as shown in the attached Form. This is a crime falling under Article 44 subparagraph 1 or 9 of the Act on the Guarantee of Workers' Retirement Benefits, which is a crime of non-prosecution pursuant to the proviso of Article 44. According to the records, it is recognized that the victims submitted a written withdrawal of complaint to the effect that they will not be punished through the defendant after the prosecution of this case. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 6 of the Criminal Procedure Act.
