From August 2017, the Defendant requested victim D, who was aware of the fact that he was operating the C mobile phone sales store on the P mobile phone B 1st floor of Busan Metropolitan City, to “it is not sufficient to register his customer on E. It is not sufficient that two persons have to register his mobile phone openings. It is not possible to open the mobile phone openings.” The Defendant attempted to raise funds by opening the mobile phone by using the driver’s license of the victim and the husband of the victim and disposing of it.

1. On October 31, 2017, the Defendant forged private documents on the E-application, which is kept without authority, for the purpose of uttering at the aforementioned C mobile phone sales store, indicated the subscriber information column as “F”, “D”, “H”, “I”, and “F” and “D” in the subscriber information column, respectively, in the subscriber’s name column, and signed each of them. < Amended by Presidential Decree No. 28420, Oct. 31, 2017>

Accordingly, for the purpose of exercising authority, the Defendant forged one copy of each application for entry in the name of F and D, a private document concerning rights and obligations without authority.

2. At the above temporary location, the Defendant: (a) delivered a copy of each of the above forged application form in F and D name; (b) as if he were a document duly formed, to the employees under the name of the EM agency, the Defendant had no knowledge of the forgery; and (c) exercised the same.

3. Although the Defendant did not have the right to open a mobile phone in F and D name and did not have the intent or ability to pay the installment fee and usage fee of the mobile phone at the above temporary location, the Defendant prepared and submitted one copy of the E-application by stealing personal information of F and D, and the Defendant was issued two cell phoness equivalent to the total market price of KRW 2,189,00 from the victim E-agency Co., Ltd.
