The instant I Forest land had seven graves for H tide, and K, at the time of purchase of the said forest land from G, had 50 square meters in 7 to 350 square meters in 70 square meters for each grave on the condition that H would have removed seven of the said grave from G at the time of purchase of said forest land.

Accordingly, on June 14, 1995, K completed the registration of ownership transfer with respect to the Gyeonggi-gu J forest.

Since then, around October 2006, the Plaintiff was delegated by K to develop the instant I forest as a housing site and divided the relevant land and sold it in lots and newly built a house with the permission for the housing site, H moved four of the seven grave period around March 2007, and if the Plaintiff sold the said J forest to the Plaintiff, the Plaintiff would have an obstacle to the remaining three grave period, thereby selling the said J forest for KRW 60 million on May 3, 2009. However, H did not change the remaining three grave period.

However, H died on October 25, 2012, and there were B, C, and D’s children as his inheritor. On October 10, 2014, B succeeded to P, Q, and R’s spouse and children who were the spouse.

The instant I Forest was divided into Gyeonggi-gu E and F Forest (hereinafter “the instant forest”). Since three graves exist as the network H moveed to each forest of this case, Defendant O and the heir of the network H, Defendant P, Q and R are obligated to remove each part of the instant forest of this case, among the said E forests, one grave with 10 square meters in line with each point of 10 square meters in line, 11 through 20, and 11 square meters in line with each point of 11 square meters in line, and 11 square meters in line with each point of 28 through 33, and 28 square meters in line, among the instant forest of this case, one grave with 1 square meters in line with each point of 28 through 33, and 28 square meters in line with each point of 4 square meters in line with the annexed drawing.
