1. Defendant A is based on the termination of the agreement on February 24, 2017 with respect to the motor vehicles listed in the attached Form.
1. Facts of recognition;
A. On March 17, 2015, the Plaintiff was running a trucking transport business under the Trucking Transport Business Act, and entered into an agreement (hereinafter “instant agreement”) with Defendant A on the following main contents (hereinafter “A” and Defendant A “B”) with regard to the motor vehicles listed in the separate sheet (hereinafter “instant motor vehicle”). Defendant B jointly and severally guaranteed Defendant A’s obligation to the Plaintiff under the instant agreement.
Article 2 (Indication of Managerial Trust Vehicle) A shall register the truck (the instant vehicle) in kind with the trucking transport business of the Party A, make an investment in kind to Party A, and Party A shall entrust Party B with the right to operate the trucking transport business of the instant vehicle.
Article 6 (Usage Fees for Permission) shall be paid to A in 253,00 won (including value-added tax) each month by the end of each month.
Article 7 (Management of Vehicles) shall bear all expenses incurred in the management and operation of vehicles, such as repair and oil of vehicles, taxes and public charges, insurance premiums, education and training.
Article 8 (Charges, Taxes and Taxes) If A provides other usage fees or specific service not included in the permitted usage fees, he may collect such fees, and Eul shall bear all taxes and taxes imposed due to the management and operation of the vehicle.
Article 12 (Insurance Premiums) B shall pay vehicle insurance premiums, cargo insurance premiums, etc. to A within the insurance period.
Article 13 (Penalty, etc.) B shall pay penalties for violation of all Acts and subordinate statutes and administrative measures due to the operation of a vehicle, and all the money and losses which have caused to A as a result of such a violation and administrative measures, within the fixed period.
Article 16 (Liability for Accident Proof) The first arrangement with A to cover the amount of money for insurance increase (including a grace period to be covered) due to an accident that occurs during the operation of the vehicle at the time of transfer or cancellation (vehicle scrapping, relocation, export, etc.) of the vehicle.
