1. The Defendants:
(a) deliver one story 282.24 square meters of real estate listed in the attached list;
(b) joint;
1. Facts of recognition;
A. On September 11, 2015, the Plaintiffs completed the registration of ownership transfer with respect to each of 1/2 shares of the instant building.
B. On September 1, 2017, the Plaintiffs and Defendant C Co., Ltd (hereinafter “Defendant Co., Ltd”) concluded a sales contract with respect to the instant building with the purchase price of KRW 2.3 billion (in the event of a contract, the balance of KRW 1.2 billion shall be paid on December 31, 2018), and the delivery date of the said building as of December 31, 2018, and the said sales contract with the following purport stated in the following special agreement:
(1) The seller (hereinafter referred to as the “Plaintiff”) and the buyer (hereinafter referred to as the “Defendant Company”) enter into a lease agreement with respect to the instant commercial building pursuant to paragraph (1) of the terms and conditions of the said contract, and the following lease agreements are concluded between the seller and the buyer (hereinafter referred to as the “Defendant Company”) upon selling and selling the instant building and at the same time until the remainder of the contract.
1) All the first floor: The entire deposit 50 million won/ monthly rent 4 million won: the deposit 30 million won/ monthly rent 30 million won: the entire 4th floor: the deposit 10 million won/ monthly rent 10 million won: the deposit 10 million won/ monthly rent 400,000 won/ monthly rent 1 million won; the above lease period of KRW 10 million from January 1, 2018 to December 31, 2023 (5 years) shall be extended further five years, and if a lessee wishes, the seller and the buyer agree that the lease deposit will be linked to the down payment.
2. Subject to the foregoing condition, in the event that any balance is not made on December 31, 2018, the seller and the buyer agree to pay a penalty of KRW 50 million out of the purchase and sale contract deposit to the seller as the amount of damages; and the buyer agree to pay the lease deposit to the seller additionally as the deposit for rent, and the buyer and the seller agree to pay the lease deposit at KRW 100 million to the seller.
5. Monthly taxes shall be paid in advance from January 1, 2018;
C. The defendant company operated the "E" franchise store, etc., and the defendant D entered into the above "E" franchise store agreement with the defendant company.
