Defendants have worked as insurance designer of the FF corporation G, an insurance agent in Daegu-gu E.

1. Defendant A

A. The Defendant, when the insurance designer runs an insurance business, paid 60 to 70% of the subscription fee in the following month by the insurance company, paid 30 to 40% in installments, and received additional incentives, other than the commission, if he/she achieved more than a certain amount of performance, and paid the premium to his/her relative or her son, etc. around which he/she did not intend to buy and maintain the insurance, using the fact that it is difficult for the insurance company to review and track whether he/she has paid the premium by proxy. By lending the name, the Defendant would be able to pay the insurance premium in his/her name after he/she purchased the insurance in his/her name or receive the fee from the insurance company without his/her intention to maintain the insurance.

On January 29, 2014, the Defendant submitted a written subscription for the insurance contract related to the “(free) KRB Life Co., Ltd. (U) KRB Life Co., Ltd. (U.), which is the monthly insurance premium of 530,000, written in the name of the insurance contractor H, to ensure that the insurance contract is concluded with the victim.

However, the above insurance contract is not a true contract that H continues to maintain an insurance contract and properly pays monthly insurance premiums, but the defendant concludes a contract under the name of H to receive fees and pays insurance premiums to a certain number of times by using insurance solicitation fees received from insurance companies. Whether to maintain the insurance contract depends on the defendant's payment of insurance premiums. The defendant has no intent and ability to pay insurance premiums after a certain period of time, and H has no intention to pay insurance premiums for a certain period of time after the termination of the contract period.
