A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The Defendant is a person who operates a DNA photographer in Daegu-gu C commercial building 105 201 dong 201, and substantially operates the “F” photographer in the name of the Defendant’s mother E.
1. On March 29, 2017, the Defendant was selected as the first priority bidder by a bid for the selection of a manufacturer of G High School who is a private school under the name of “F” on the website of the “State Funeral” managed by the Public Procurement Service.
G High Schools limited the eligibility for participation in the above bidding to companies with three or more times of supply to educational institutions within the last three years, but “F” did not have such results.
On March 2017, the Defendant, using a computer at the office of “D photographer”, stated “D’s delivery performance verification sources, trade name: D/F, and the above delivery performance verify that the above delivery performance is not superior, and H cooperative president.” The Defendant stated the supply performance of “F” from around 2011 to around 2016 and “D photographer,” together with the supply performance of “D photographer,” and then printed it with the seal affixed by the president of H Cooperatives, affixed with the Defendant’s seal affixed to other delivery performance verification sources, which had been normally issued and kept by the Defendant.
Accordingly, for the purpose of exercising, the Defendant forged one copy of the supply performance certificate under the name of the president of the H Cooperatives, which is a private document on proof of facts.
2. On March 2017, the Defendant exercised the said investigation document: (a) at the JJ high school administrative office located in Suwon-gu, Daegu-gu, Daegu-gu, the Defendant issued to K employees who knew of the forgery as if he were the document duly formed one copy of the certificate of supply record; and (b) exercised that document.
3. An electronic bid for the selection of a manufacturing company (hereinafter referred to as "electronic bid") through the National Integrated Electronic Procurement System (hereinafter referred to as the "International Procurement System") operated and managed by the Public Procurement Service and the Daegu Office of Education;
