Around December 7, 2019, the Defendant stated that “Around December 7, 2019, the Defendant would send a gallonian 8,000 won if he deposits KRW 165,00 to the victim C, a foreigner who reported and contacted the said sales, by accessing the Internet B to a cellular phone at a place where the address of not more than Gwangju Northern-dong is unknown.”

However, in fact, the defendant did not have gallonian no longer have 8, and there was no intention or ability to sell it.

On the same day, the Defendant received 165,000 won from the victim to the D Association account (E) in the name of the Defendant.

Accordingly, the defendant was given property from the victim by deceiving the victim.

Around December 12, 2019, the Defendant stated that “The Defendant would send a heavy Handphone when remitting KRW 165,000 to the victim I who reported and contacted that “I would sell a heavy Handphone 8” by accessing the G sales site B using a heavy Handphone (H) used by the Defendant,” and “I will send a heavy Handphone when remitting KRW 165,000.”

However, the defendant did not have an intention or ability to sell a mobile phone because he did not have a heavy cell phone.

On December 13, 2019, the Defendant, by deceiving the victim, received 165,000 won from the post office account under the name of the Defendant (J) around December 16, 2019, and received 1,386,400 won in total from that time by deceiving the victims over 10 times in total, as shown in the list of crimes in attached Table 1, from January 12, 2020.

On July 13, 2018, the Defendant was sentenced to two years of imprisonment for fraud, etc. in the Gwangju District Court’s net support on July 13, 2018, and was released on October 28, 2019 and completed the execution of the sentence on February 12, 2020.

On January 11, 2020, the Defendant sold a mobile phone on the mobile bulletin board in the vicinity of Gwangju City.
