On June 24, 2009, the Railroad Labor Relations Group, a labor union consisting of the employees of the Korea Railroad Corporation (hereinafter “railroad”) on the main axiss of June 24, 2009, took part in the 2,500 members belonging to the Seoul Station on April 25, 2009 by holding a “Radern Labor Force Resolution for Railroad Workers” and asserted the “affort of labor-management pressure by raising public enterprises, 5,115 population reduction and welfare reduction, preparation of the basic measures for the Incheon Airport Railroad, such as the democratization of public corporate governance structure, compensation for damages, and dismissal of labor-management complaint.”

On June 17, 2009, Y of the Central Committee for Countermeasures against Railroad Labor Relations shall, in order to accomplish the above arguments, drive a member on board a train in consideration of the safety of transportation personnel when entering the train. The transportation personnel shall cooperate with the examination of the regulations of the tallyman. They shall comply with various restricted speed. They shall thoroughly conduct the operation test. They shall maintain the entry and exchange speed at all times at the safe speed. They shall thoroughly implement the entry and exchange speed. The Y issued the “Guidelines for Safety Operation of Regulations” with the content that “the vehicle members shall safely examine as prescribed by the regulations.”

On June 24, 2009, Defendant C, the head of the Z headquarters in the Railroad Labor Management Z Headquarters, and the head of the Organization Bureau, in accordance with the Guidelines for the Safety Operation of Regulations, instructed the members AB and AC, who are the members of the Zz headquarters, of the vehicle headquarters in AA, to refrain from operating trains normally and to delay operation at the vehicle office located in the Ministry of Zbu on June 24, 2009.
