From 2009 to 2011, the Defendant was absent from the Internet gambling, and continued to dispose of assets or borrow money after being punished six times as a crime of gambling. However, on around 2016, when it was difficult to seek money to use as gambling funds, etc. any more than 1.8 billion won of the borrowed money was used in around 2016, the Defendant received money from the victim E who was her friendship-gu around 2013.

1. On May 18, 2016, the Defendant told the victim of Seongdong-gu Seoul Metropolitan Government F building that “The Defendant shall pay the Plaintiff a full payment with the interest of KRW 10% after one month, if he/she lends the investment amount of KRW 20 million to purchase the main innovation city commercial building.”

However, the defendant thought that he will use the borrowed money for gambling, and there was no idea to purchase the original innovation city commercial building, and there was no intention or ability to repay the money.

The defendant deceivings the victim by such false statement as above, and he acquired 20 million won from the victim to the national bank account in the name of the defendant on the same day.

2. On May 24, 2016, the Defendant called a phone to the victim on May 24, 2016, and left the victim with “The Chairperson G H/W and F/W.”

H In order to purchase Korea's gift certificates, money is fested.

In the case of lending KRW 10,000,000, the gift certificates will be purchased and the last 6% interest shall be paid with the loaning KRW 20,000,000.

However, the defendant thought that he will use the borrowed money for gambling, and there was no idea to purchase merchandise coupons, and there was no intention or ability to pay the money.

The defendant deceivings the victim by such false statement as above, and he acquired 10 million won from the victim to the same account on the same day.

3. On May 27, 2016, the Defendant received a loan from the victim at the first floor J stores of the 1st floor in Seongbuk-gu Seoul Special Metropolitan City, Sungnam-si, with the knowledge of the lending company if there is no money.
