The request for retrial is dismissed.
The litigation costs for retrial shall be borne by the plaintiff.
Reasons
The plaintiff (the plaintiff) asserts that there are grounds for retrial under Article 451 (1) 1 of the Civil Procedure Act, namely, grounds for retrial under the law.
However, the materials submitted by the Plaintiff (Plaintiff) alone cannot be recognized as grounds for retrial as alleged in the judgment subject to retrial, and there are no other materials to recognize that there exists a ground for retrial in the judgment subject to retrial.
Therefore, the retrial costs are dismissed, and the costs of retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
