[2] On December 22, 2016, the Defendant was sentenced to ten months of imprisonment for fraud, etc. at the Busan District Court, and on May 5, 2017, three times each of the same larceny and fraud records, including the termination of the execution of the sentence in the Busan Detention House.

[Criminal facts]

1. On August 18, 2017, the Defendant brought about 800,000 won of the smartphone market in the gallon-owned Samsung-phone market owned by the victim, who was located on the floor in the victim E, around 02:54, at the 3rd floor of the soup room located in the racing city, on August 18, 2017.

In addition, the Defendant’s list of offenses committed between May 28, 2017 and August 22, 2017, as well as the list of offenses committed by the Defendant.

(a) 12 times in total, such as the description, brought a total of KRW 90,000,000,000, including smartphones.

Accordingly, the defendant stolen the victims' property.

2. On August 18, 2017, around 03:43, the Defendant used computers, etc.: (a) accessed F convenience points near the soup room as set forth in the foregoing paragraph 1; (b) connected the Defendant’s smartphone with the Defendant’s own smartphone to “Abe”, which is the site for the transaction of an item, colors the applicant for the purchase of the “A” game items (Chh), and was delivered a ID from his name in response thereto; and (c) entered the stolen victim E’s smartphone as set forth in the foregoing paragraph 1, with the victim’s smartphone into the “I” game and then settled a small amount of money without the victim’s consent; and (d) purchased the game items at the price of KRW 495,000,00 in the name of the Plaintiff and received the said item “360,000 won” from the said owner’s name in the way of settling the amount of money without the victim’s consent.

In addition, the Defendant’s list of offenses committed by using another’s smartphone that was stolen between around August 8, 2017 to around February 22 of the same month.

B. Among them, such as Nos. 1 through 5, 7, the game items in an amount equivalent to KRW 2,200,000 in total on six occasions to the applicants for the purchase of the item, and one thousand five or more3,625 won from those persons.
