The court does not necessarily have to consolidate arguments because the defendant applied for the consolidation of pleadings, and even if such application is made, the issue of consolidation of pleadings belongs to the discretion of the court.

(See Supreme Court Decision 87Do706 delivered on June 23, 1987, etc.). Accordingly, even if the instant case was not tried concurrently with other cases, it cannot be said that there was no illegality in the lower court’s litigation procedure.

Ultimately, we cannot accept the argument in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
