가. 소외 F은 2017. 1. 21. 22:47경 혈중알코올농도 0.203%의 술에 취한 상태에서 G 스타렉스 차량(이하 ‘피고 차량’이라 한다)을 운전하여 부산 해운대구 H에 있는 I마트 앞 도로를 진행하던 중 진행방향 우측 길가에 설치된 제설함을 피고 차량 우측 앞 범퍼 부분으로 들이받아 위 제설함이 인도 쪽으로 튕기면서 때마침 I마트 앞 인도를 보행 중이던 원고 A의 얼굴 부위를 충격하게 하였다

According to the above recognition of the occurrence of liability for damages, the Defendant, as the insurer of the Defendant’s vehicle, was injured by the Plaintiff A due to the operation of the Defendant’s vehicle, barring special circumstances, is liable for compensating the Plaintiffs for the damages caused by the instant accident

3. In principle, a period of time for calculating the scope of liability for damages shall be calculated on a monthly basis, but less than the last month and less than KRW 10 shall be discarded.

The calculation of the current value at the time of the accident shall be based on the reduction rate of 5/12 percent per month to deduct the interim interest.
