1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the first instance court.
1. Facts of recognition;
A. 1) The Plaintiff is the deceased C (hereinafter “the deceased”) who works as the professor of the business management department at B University.
2) The Defendant is a juristic person established pursuant to the Pension for Private School Teachers and Staff Act, the purpose of which is to contribute to the stabilization of the economic life and the enhancement of welfare of the teachers and staff and their bereaved families, by establishing an adequate benefit system for the retirement and death of the teachers and staff of private schools, and
B. (1) The Deceased took part in the “D” course established at the Lifelong Education Institute annexed to B University in the summer semester in 2017. The class students, including the Deceased, were five professors of B University and six general workers. (2) The instructor E of the instant course decided to hold the “F” event (hereinafter “instant event”) in place in lieu of the class lecture, and went out of the venue of the event (G G G in G in G in G in G in G in G in G). Of the class students, four professors and five general workers agreed to participate in the instant event.
3) Around 17:00 on August 8, 2017, the Deceased died due to a traffic accident where cargo vehicles died while getting on and off the instant vehicle while attending the instant event by Han medical college and Han professor H. C. The Defendant’s refusal to pay bereaved family compensation claim for the reason that the deceased died due to an official accident. However, the Defendant refused to pay bereaved family compensation claim on January 22, 2018 following the Pension Benefits Council for Private School Teachers and Staff, on the ground that “the instant event was not obtained prior approval or approval from the school, the question of attending the lifelong education center course is determined by the principal’s will, and it cannot be recognized that the deceased died due to an accident that occurred while performing his/her duties.”
2. The plaintiff shall review the decision to refuse to pay bereaved family's compensation to the Deliberative Committee on Pension Benefits for Private School Teachers and Staff.
