A defendant shall be punished by imprisonment for four years.
Seized evidence shall be confiscated in accordance with subparagraphs 2 through 6, 10 through 26, and 28 through 43.
Punishment of the crime
[Criminal record] On August 28, 2014, the Defendant was sentenced to one year of imprisonment with labor for a violation of the Narcotics Control Act at the Seoul Central District Court on the grounds of a violation of the Act on the Control of Narcotics, etc., and completed the execution of the sentence on May 25, 2015.
[Criminal facts] The Defendant is not a narcotics handler
1. Violation of the Act on the Control of Narcotics, etc. due to the importation of drugs with a psychotropic spirit;
A. On September 21, 2015, the Defendant issued an order to “C” one of the instant medical devices located in China, using the mobile phone Messenger program, using the mobile phone Messenger program, and transferred KRW 2,660,000 to the C bank account in the name of “C” on September 21, 2015. < Amended by Presidential Decree No. 2660, Sep. 21, 2015>
Then, the Defendant, around October 6, 2015, entered the Incheon International Airport No. 424, 424, a route 47, a Jung-gu Incheon, Jung-gu, Incheon, as aviation E for a container manufactured in a false and healthy form, using an international cargo (debrison) at around 07:3 on October 6, 2015, and received from an employee of the international transportation company who is unable to identify the name on the road for front buildings in Seoul, the Jung-gu, Seoul., and received the case from the employee of the international transportation company.
B. In October 2015, the Defendant issued an order to “C” in the name of “C” in China, using a mobile phone Messenger program at a place where the Defendant was a police officer from the beginning of October 2015. On October 6, 2015, the Defendant transferred KRW 2,618,700 to the C-bank account in the name of “C” designated by the “C” around October 6, 2015.
Then, around October 7, 2015, the Defendant arrived at the Incheon International Airport No. 424 m. 424, Incheon Jung-gu, Jung-gu, Incheon, by aviation E for approximately 64.12g of Handphonephonephones in a container made in a false form, disguised with international transportation of cargo (nets) at around 07:25.
Accordingly, the defendant imported a local mental medicine more than twice.
2. A defendant who violates the Act on the Control of Narcotics, etc. due to the number of drugs with a psychotropic spirit (compact) shall be around 17:00 on September 17, 2015.
