Notwithstanding the above court decision, the Defendant continued to demand repayment of money and provision of security from the victim without returning money to the victim, and had telephone conversations with the victim around July 30, 2014, and had the victim visited the victim's residence on July 31, 2014, in order to discuss the issue of establishing the right to collateral security.

피고인은 2014. 7. 31. 11:30경 피고인의 집에 찾아 온 피해자의 뒷머리 부분을 불상의 도구로 강타한 후 끝이 뾰족한 도구를 이용하여 내리찍어 외상성 두부 손상으로 인하여 피해자를 사망하게 하였다.

2. On July 31, 2014, from around 12:40 to around 13:10 on July 31, 2014, the Defendant: (a) was killed of the victim; (b) was loaded the victim’s body in the H cargo vehicle; (c) was located near the Incheon Reinforcement-gun I Complex near the 1km away from the Defendant’s dwelling area; and (d) was 25 cm in depth and 130 cm in length from the beginning of the mountain at that place; and (c) laid down the victim’s body with soil; and (d) laid down the victim’s body with soil.
