1. The Defendant’s KRW 35,744,083 as well as 6% per annum from October 12, 2018 to July 18, 2019 to the Plaintiff.

Reasons

1. Basic facts

A. On June 23, 2008, the Plaintiff entered into a delegation contract (hereinafter “instant delegation contract”) with the Defendant who operates the import-sale business of machinery and equipment in Korea, setting the contract period of three years, and worked as the representative director of the Defendant.

The Plaintiff and the Defendant renewed the above contract once thereafter, but extended the contract period from July 1, 2014 to June 30, 2017, when the contract period expires.

B. Article 5 (2) of the delegation contract of this case provides that the amount which forms the basis for the calculation of the performance bonus for the representative director shall be KRW 40 million, and the defendant of this fiscal year shall be the defendant of this case.

(C) The Plaintiff and the Defendant agreed to raise the basic amount for the calculation of the performance bonus as KRW 47,270,256 from March 2, 2014 to March 2015, by paying an amount calculated by multiplying the target achievement grade (50% to 150%) and, if the representative director retires before the expiration of the fiscal year, it is paid in proportion to the actual working period. The Plaintiff and the Defendant agreed to raise the basic amount for the calculation of the performance bonus as KRW 47,270,256. The Plaintiff concluded a contract with the Defendant and resigned from the Defendant (hereinafter referred to as the “instant resignation contract”).
